Driver Is Responsible for Passengers!

Driving a car, the driver must assume all the responsibilities. As such, he must be ensured for passengers and ensure compliance with safety rules.

Car insurance mandatory

Car Insurance LiabilityRemains just this last resort does not relieve drivers to ensure their passengers. Rather, the owners of “land motor vehicles” are required to purchase insurance “liability”. This is the only mandatory statutory warranty, but it is essential.

Otherwise, they face a penalty to pay, which may add additional penalties such as suspension or cancellation of the license.

Compensation to all passengers in case of accident

The insurance “liability” covers all damages (material and moral) that the driver can cause passengers it carries.

With it, all occupants of the vehicle (driver’s spouse, children, friends, colleagues, hitchhiker …) will be compensated in case of accident, whatever the circumstances of the collision: careless mistake, refusal priority, speeding, snow, rain, driving while intoxicated, driving without a license…

It is also irrelevant that the passengers are not in a position or infringement upon the facts (for example, they were not wearing their seatbelts).

Two exceptions to this principle: Firstly, if you lend your car while your contract mentions as one conductor (“conduct exclusive contract”), a franchise will be your responsibility. In addition, insurance may refuse to compensate a passenger if his attitude is the “sole cause of the accident.” This situation is extremely rare and does not apply if the victims are under 16 or over 70 years.

Compensation, instructions

Any driver involved in an accident must report to his insurer, and provide contact information for passengers.

They are contacted and, if necessary, compensated by insurance without having to make special approach. In practice, an expert evaluates the personal injury and equipment of each victim (on a scale of values) to determine the amount of compensation paid.

It is intended to cover all injuries suffered (expenses not covered by complementary health, loss of professional earnings, disfigurement, equipment, assistance by a third person, etc…). If the amount is offered does not satisfy you, you can ask another expert to evaluate, at your expense, your damage.
